Heard Mr. Tamhane, learned Counsel for the applicant, Mr. Kanchan, learned Counsel for respondent No.1 and Ms Kaushik, learned APP for respondent No.2State. 2.

By this application, the wife has prayed for condoning the delay of 27 days in filing the Criminal Revision Application. Mr. Tamhane invited my attention to the grounds set out in paragraphs 4 and 5 and submitted that for the reasons set out therein, delay deserves to be condoned. On the other hand Mr. Kanchan submitted that no sufficient cause is made out for condoning the delay.

Having regard to the fact that the applicant-wife is 1/2

APPR320_14.doc challenging the grant of maintenance and further having due regard to the fact that there is delay of 27 days, for the reasons set out in paragraphs 4 and 5, I am satisfied that applicant has made out sufficient cause for condoning the delay. Hence, application is allowed in terms of prayer clause (a) with no order as to costs. Office shall register the Revision Application if it is otherwise ready. Criminal Application No.320 of 2014 is disposed of accordingly. 4.

List the Revision Application for admission on 20.01.2015.
