Heard learned counsel for the parties.

By this application, the applicant seeks suspension of his sentence and enlargement on bail, pending the hearing and final disposal of the aforesaid Revision Application.

The applicant vide Judgment and Order dated 30th January 2017, passed by learned Judicial Magistrate First Class, Court No.1, Pune, 1/3
in R.C.C. No.114 of 2000 was convicted for the offences punishable under Sections 408 and 465 of the Indian Penal Code and was sentenced to suffer rigorous imprisonment for two years and was directed to pay a fine. Being aggrieved by the said Judgment and Order of conviction and sentence, the applicant filed an Appeal in the Sessions Court being Criminal Appeal No.91 of 2017. The learned Additional Sessions Judge, Pune, vide Judgment and Order dated 3rd December 2021 maintained the conviction of the applicant for the offences punishable under Sections 408 and 465 of the Indian Penal Code, however, reduced the sentence from two years to one year. The applicant is in custody since December 2021. The applicant was on bail pending trial and has not misused or abused the liberty granted to him. The Revision Application has been admitted by a separate order passed today and the same is not likely to come up for the hearing in the immediate near future. The sentence awarded is a short term sentence. 4.
Considering the aforesaid, the application is allowed and the applicant's sentence is suspended and he is enlarged on bail, pending the hearing and final disposal of his Revision, on the following terms and conditions :

ORDER
i) The Applicant be released on cash bail in the sum of Rs.15,000/-, for a period of eight weeks;
ii) The Applicant shall within the said period of eight weeks, furnish P.R. Bond in the sum of Rs.15,000/- with one or two sureties in the like amount;
iii) The Applicant shall report to the Sessions Court, once in six months on the day/date specified by the Sessions Court, till his Appeal is finally disposed of;
iv) The Applicant shall keep the Sessions Court informed of current address and mobile contact number and/or change of residence or mobile details, if any, from time to time.

The Application is allowed in the aforesaid terms and is accordingly disposed of.
