Heard Mr. Joshi, learned Counsel for the petitioner/applicant and Mr. Shetye, learned Counsel for the respondent. Mr. Joshi submits that next date before the executing Court is 9th April, 2018.

Mr. Joshi states that the petitioner is residing in the suit premises along with his mother and wife and nobody else is residing there. He further states that he has not created third party interest and he will neither part with possession nor create third party interest and he will deposit arrears of rent, if any, in this Court under intimation in writing to the learned Counsel for the respondent before the next date of hearing. He shall annex copy of the trial Court's order dated 19th December, 2016 and serve copy on the other side. 5.

As the petitioner has specifically prayed for stay of the impugned order, Civil Application No.2487 of 2017 for the same relief stands disposed of.
