Heard the learned counsel for the petitioner and the learned counsel for the second respondent. The learned counsel for the petitioner states that the petitioner will make a fresh representation to the Thane Municipal Corporation within a period of one month from today. We accept the said statement. The learned counsel for the second respondent states that if such a fresh representation is made, the Thane Municipal Corporation will take appropriate decision thereon after giving an opportunity to all concerned parties. We accept the said statement.

Accordingly, we direct that if a fresh representation is made by the petitioner, the Thane

wp9119 Municipal Corporation shall take appropriate decision within a period of three months from the date on which the representation is made.

The decision taken on the said representation shall be communicated to the petitioner.

We make it clear that we have made no adjudication on the merits of the controversy involved in this petition. Writ petition is disposed of.
