The petitioner challenges the order passed by the President Industrial Court, Mumbai dated 27/8/2015 rejecting the application for transfer of the Application (IMRTU) No.3/2014, pending on the file of the Industrial Court at Nasik. 2.
Heard the learned counsel for the petitioner and I have gone through the copy of the impugned order. The President, Industrial Court examined the case and formed an opinion that it is not necessary to transfer the matter to any other Court on the grounds asserted by the petitioner and has opined that if such request is allowed, it would set up a bad decision. In a writ jurisdiction, especially in the matter such as these, Court would be slow to substitute the opinion formed by the learned President. Further I do not find that there is any perversity in the view taken.
rsk 2 WP-11458-15.doc Neither there is any failure of justice. Merely because another view is possible, the discretion exercised by the Industrial Court can not be interfered with. Writ petition is rejected. ( N. M. JAMDAR, J. )
