Heard learned counsel for the applicant and learned APP for the State.

This is an application for bail in respect of the offence punishable under Sections 498-A, 304-B, 306 read with 34 of the Indian Penal Code (hereafter 'IPC' for short) registered on 16.11.2019 vide FIR bearing C.R. No.315 of 2019 with Aale-Phata Police Station, Pune.

The applicant married the deceased-Jyotsna on 23.02.2018. It is the accusation that the applicant illtreated the deceased. The accusations no doubt are serious. 1/3

The complainant's daughter committed suicide on 15.11.2019. The applicant was arrested on 17.11.2019. The applicant is in custody almost for a period of four years. The charge has not been framed. The applicant will face the consequences of the trial if found guilty. The investigation is complete and the charge-sheet has been filed. There are no criminal antecedents reported against the applicant. Considering the long incarceration of the applicant as an under-trial I am inclined to enlarge the applicant on bail in the facts and circumstances of the present case. Hence, the following order :-

O R D E R

(a) The application is allowed.

(b) The applicant-Jaysing Ramdas Hadwale in connection with FIR bearing C.R. No.315 of 2019 registered with Aale-Phata Police Station, Pune shall be released on bail on his furnishing P.R. Bond of Rs.25,000/- with one or more local sureties in the like amount.

(c) The applicant shall attend the Investigating Officer of Aale-Phata Police Station, Pune once in a 2/3

month every first Monday of the month between 11.00 a.m. and 1.00 p.m.

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicant shall not tamper with evidence. (e) On being released on bail, the applicant shall furnish his contact number and residential address to the Investigating Officer and shall keep him updated, in case there is any change.

(f) Except for attending the trial the applicant shall not enter the area of Chikhali, Taluka Haveli, District Pune after being released on bail, till the trial concludes. (g) The applicant shall attend the trial regularly. The applicant shall co-operate with the trial Court and shall not seek unnecessary adjournments.
