IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL WRIT PETITION NO. 4338 OF 2015 Mr. Karim Amirali Daredia and ors.

.. Petitioners Vs.

1. Mr. Nadeem Qureshi and anr.

.. Respondents Mr. Trivankumar Karnani for petitioners.

Ms. S. V. Sonawane, APP for State.

CORAM: NARESH H. PATIL & A. M. BADAR, JJ.

MARCH 21, 2016.

P.C.

1.

The grievance of the petitioner is that investigation in C.R. No. 249 of 2015 registered at the Bandra Police Station is not carried out properly. There are cross cases. Learned counsel appearing for the petitioners has narrated some instances from which it was tried to be canvassed that the investigation is not being conducted in fair and proper manner.

2.

Learned APP, on instructions, submits that within a week's time investigation will be completed in C. R. No. 249 of 2015. Learned APP further submits that the apprehensions expressed by the petitioners are

21-wp-4338-15 baseless. In C. R. No. 249 of 2015 the police added charge for offence punishable under Section 326 of the Indian Penal Code. The learned APP, on instructions from the officer, who is present in court, submits that another FIR is numbered as C.R. No. 246 of 2015 and in that C.R. too the police would be filing charge-sheet.

3.

In view of the above developments, we are not inclined to entertain the petition. Keeping all the issues on merits open, petition is disposed of.
