The applicant is seeking bail in CR No.201 of 2014 dated 12.5.2014 registered with Dharavi Police Station under Sections 307, 323, 506(2), 143, 147 read with Section 34 of the Indian Penal Code and Sections 4 and 25 of the Indian Arms Act and under Section 27(1)(3) read with Section 135 of the Mumbai Police Act.

The learned Counsel for the applicant submitted that other three co-accused namely Alex, Muthu Lingetar and Mari are already released on bail by the Trial Curt and as the applicant is similarly situated, the principle of parity is applicable to him. The learned APP on instructions conceded to the said submission.

In view of the above, I am inclined to release the applicant on bail. Hence, the following Order:

(i) The applicant shall be released on bail in CR No. 201 of 2014 dated 12.5.2014 registered with Dharavi Police Station on his executing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount; (ii) After his release on bail, the applicant shall attend the concerned Police Station on every Monday between 10.00 a.m. to 2.00 p.m. till the completion of trial;

(iii) The applicant shall not enter within the jurisdiction where the complainant resides till the completion of trial; (iv) The applicant shall not indulge into any kind of criminal activities after his release from jail;

(v) The applicant shall not leave Mumbai without permission of the Trial Court;

(vi) The applicant shall not tamper with evidence and/or influence the prosecution witnesses.
