Heard Mr. P.S.Dani, learned senior counsel for the petitioner and Mr. Vaibhav Joglekar, learned senior counsel for respondent no.1 at length.

For the reasons to be recorded separately, Petition fails and the same is dismissed with exemplary costs of Rs.50,000/- to be paid by the petitioner to respondent no.1-decree holder within 4 weeks from today.

In case, judgment debtor no.9 fails to pay the costs within four weeks from today, Collector, Nashik shall recover the same as a land revenue. In case judgment debtor no.9 obtains any suitable order against this order, the same shall be intimated to Collector, Nashik, forthwith.
