Not on board. At the request of Advocate for the petitioner, matters are taken on board for urgent orders.
The issue involved in all these Writ Petition is identical. Hence, the common order is passed. Heard the learned counsel for the parties.
The main grievance of the petitioner in all petitions is that though the Respondent No.2 Deputy Registrar Co. Op. Societies, Solapur passed order under Section 77A(1)(b) and (f)(2) of Maharashtra Co. Op. Societies Act, 1960 appointing Respondent 1/3
No.4 as Administrator to complete the process for holding election of Respondent No.3 society, he failed and neglected to do so. Thereafter, the Petitioners preferred Appeals before Divisional Joint Registrar, Co. Op. Societies Pune, Division Pune. In that Appeals, they preferred the stay Applications. Those stay applications were rejected by Respondent No.1 Divisional Joint Registrar. Hence, they preferred the present Writ Petitions.
It is to be noted that tenure of Board of Directors/Managing Committee of all the societies came to an end.
Considering this fact and as the Respondent No.4 who was appointed as Administrator to complete the process of election and hold the same and he has not done anything till today, the following order is passed:
a) Respondent No.4 is directed to complete the process of election and hold the same as early as possible, but in any case on or before 31.12.2016. b) Liberty granted to the petitioner to move before this court, in case Respondent No.4 failed to take appropriate steps immediately within time as stated herein above.
c) With these directions, all these Writ Petitions are disposed of.
d) Petitioners are directed to serve the copy of this order on Respondent No.4 immediately so 2/3
that he can take action.
e) Parties are directed to act on authenticated copies of this order.
