By this Application the Applicant has sought to condone the delay of 43 days in filing Application for Leave to Appeal. 2.
Heard Mr. Toshnival, the learned Counsel for the Applicant and Mr. Jadhav, learned APP for Respondent-State. I have considered the submissions and perused the record. The reasons mentioned in paragraphs 2 and 3 of the Application reveal that the Applicant was unable to file the Appeal within a period of limitation as he had to make financial arrangement and seek legal advice.

In my considered view, the reasons spelt out in paragraphs 2 and 3 of the Application constitute sufficient ground. Hence the Application is allowed. Delay of 43 days in filing Criminal Application for Leave to Appeal is condoned.
