1. Heard learned counsel for the respective parties. Interim Application No.2332 of 2022 seeks condonation of delay in filing First Appeal (St.) No. 25313 of 2021 by the legal heirs of the deceased. The delay is of 4 years 126 days.

2. Ms. Kundu, learned counsel for the appellants points out that the impugned judgment and order dated 17.05.2017 has also been challenged by the Insurance Company in First Appeal No. 981 of 2017 in this court and the said First Appeal is at the pre-admission stage.

3. Perused the Interim Application. For the reasons mentioned therein, the delay on behalf of the claimants to file the First Appeal stands condoned.

4. Interim Application No. 2332 of 2022 stands disposed. Learned counsel for the applicant submits that she shall remove the objections and number the First Appeal before the next date.
