Heard learned Counsel for the petitioner.
By this petition under Articles 226 & 227 of the Constitution of India the Petitioner challenges the order dated 10.10.2016 passed by learned Member, Industrial Court, Thane below Exh. UA-2 in Complaint (ULP) No. 161 of 2015 rejecting petitioner's application for joining them as complainants in Complaint (ULP) No. 161 of 2015. In the present proceeding, the Respondent No.1 filed complaint under Section 28 r/w Item 1(a) and 4(a),(f) of Schedule II and Item 9 and 10 of Schedule IV of Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971 before the Industrial Court at Thane for grievances. During the pendency of the said complaint, some of the members formed separate Sneha Chavan 1/2
18 wp 591-17=.doc internal Union and made application for joining them as complainants. That application was rejected by the Industrial Tribunal observing that if the petitioners have any grievances, they can file separate complainant on their won.
Considering this fact and the reasons given by the Industrial Court, I do not find any reason to entertain the present Writ Petition.
Hence, Writ Petition stands rejected.
