The Applicant, apprehending arrest, in connection with investigation of Crime No.281/2021 of Police Station Saswad, Pune Rural, under Section 306 and 507 r/w. 34 of IPC, is seeking anticipatory bail.

The aforesaid crime is registered on the basis of the complaint dated 27 July 2021 lodged by Sukhdev Shivram Zende.

I have heard the learned counsel for the parties. Perused record.

The record discloses that by detailed order dated 22 December 2021, the Applicant has been granted interim protection on condition of attendance with the concerned Police Station. The learned counsel for the Applicant points out that the Applicant has reported to the Investigating Officer and has cooperated with the Investigating Agency. It is submitted that there is no role attributed to the Applicant in the matter of the alleged abetment to suicide.

Learned APP did not dispute that except the allegation that the Applicant was present, there is no overtact attributed to the Applicant. She submitted that the investigation is at a concluding stage and the chargesheet is likely to be filed shortly. 6.

In that view of the matter, the Criminal Application is disposed of, in terms of the order dated 22 December 2021, which is hereby made absolute, subject to the condition that the Applicant shall report to the Investigating Officer as and when called and shall cooperate with the Investigating Agency and shall not tamper with the prosecution evidence / witnesses.
