The Applicant seeks modification of order dated 21 September 2016 passed by this Court in Bail Application No.1627 of 2016. The Applicant has been released on bail in connection with CR No.166 of 2016 registered with Azad Maidan Police Station on his furnishing PR bond of Rs.2 lakh with one or two solvent local sureties. The Applicant was further permitted to temporarily furnish cash bail and within six weeks, the Applicant was directed to comply with the directions of furnishing solvent sureties.

In pursuant to the aforesaid order, the Applicant has been released on bail on furnishing cash bail. Learned counsel for

2 of 2 APPP.917.2016 Applicant submits that it is difficult for the Applicant to arrange two solvent local sureties as directed by this Court. He prayed that the order may be modified to the extend that the Applicant may be permitted to furnish two solvent sureties from the State of Maharashtra instead of two local solvent sureties. Learned APP has opposed the prayer.

Taking into consideration the difficulty expressed by learned counsel for Applicant, presently the Applicant is permitted to continue on cash bail for a further period of six weeks from today and within that period the Applicant should comply the procedure for furnishing the sureties. The Applicant will be at liberty to make a prayer for modification of the order passed by this Court with regards to furnishing of solvent local sureties, in the event he is unable to arrange the local sureties within extended period. 4.

With the above observations, Criminal Application No.917 of 2016 is disposed of.
