Heard learned counsel for the Applicant.

By this application, the Applicant seeks provisional cash bail as also 8 weeks time to furnish surety as directed by the learned Sessions Judge vide an order dated 22nd August, 2019, by which the applicant was enlarged on bail.

Perused the papers. It is not in dispute that the applicant was enlarged on bail by the learned Sessions Judge vide an order dated 22nd
2/3 August, 2019 passed in Bail Application-Exhibit 10 in Sessions Case No.473 of 2018 on furnishing P.R. bond of Rs.50,000/- with one or more solvent sureties in the like amount. Certain other conditions were also imposed. Learned Judge specifically rejected the prayer of cash bail. Hence, this application.

Learned A.P.P, on instructions does not dispute the fact that role of the applicant is similar that of the co-accused- Hemant Gaud, who has been released on bail by this Court [Revati Mohite-Dere, J.] vide order dated 11th June, 2019 in in B.A. No.866 of 2019. Whilst granting bail to Hemant Gaud, this Court released him on cash bail in the sum of Rs.20,000/- for a period of 8 weeks within which he was directed to furnish P.R. Bond in the sum of Rs.20,000/- with one or more sureties in the like amount.

Considering that role of Hemant Gaud is similar to that of the applicant, the applicant is directed to be released on provisional cash bail of Rs.50,000/- for a period of 8 weeks within which period, the applicant shall comply with the order dated 22nd August, 2019 passed by the learned Sessions Judge. Rest of the conditions imposed by the learned Sessions Judge to remain as it stands.
