This is a petition filed under Section 11 of the Arbitration and Conciliation Act, 1996. Today both the learned counsel state that they are agreeable to refer the disputes and differences arising under the Memorandum of Understanding, annexed at Exhibit-C to the petition, to the sole arbitration of Mr. V.P. Utpat, Retired District and Sessions Judge, C-70, Mahaveer Park, Behind Nexa Showroom, Pune-Satara Road, Pune-411037. 2.

In view thereof, I pass the following order :- (i) Mr. V.P. Utpat, Retired District and Sessions Judge, is appointed as Sole Arbitrator to adjudicate upon claims and counter claims, if any, 1/2 31-ARP-122-2019.doc Dixit

(ii) The learned Arbitrator is requested to file his disclosure statement under Section 11(8) and Section 12(1) within three weeks from today with the Registrar (Judicial-I) and provide copies to the parties.

(iii) The Arbitrator is also requested to convene a preliminary meeting at his earliest convenience. (iv) Fees payable to the Sole Arbitrator will be in accordance with the Bombay High Court (Fee Payable to Arbitrators) Rules, 2018.

(v) Arbitration Petition is disposed in the above terms. (vi) No costs.
