The petition is filed for the following relief: "(a) That this Hon'ble Court be pleased to issue a Writ of Mandamus or any other Writ in the nature of Mandamus directing the Respondent Nos. 1 to 4 to take appropriate actin for removal of the Dumping Ground situate at village Lonipada in the Dahanu Nagar Parishad area to shift the dumping ground from village Lonipada to village Kainad or some other suitable dumping place of the Respondent No.1."

On behalf of respondent No.6, one Sandesh Patil has filed an affidavit dated 4.4.2018. In para 6 thereof, the following averments are made :- "6.
I say that earlier the land mentioned in the petition i.e. land of Respondent No.7 at Lonipada, was used to sold waste management however the villagers of the said Lonipada objected the same and several times not allowed the vehicle carrying the said waste to dump at the aforesaid place hence it was decided that the waste management of Lonipada will be closed and same will be done at another place accordingly the waste management i.e. dumping of waste at the place Lonipada is closed and said fact is already informed by the Respondent No.6 to the Respondent No.1 vide letter dated 26th September 2017. "

In the light of above, it is clear that the sold waste management at Lonipada is closed. The grievance of the petitioner therefore no more survives. The petition has rendered infructuous and the same is dismissed.
