This application is preferred by opposite party Union of India for condonation of 424 days delay in filing First Appeal challenging judgment and award dated 17.07.2008 passed by M.A.C.T. Mumbai in Application no. 3035 of 2003.

Considering the submissions made by learned counsel for the applicant and averments made in civil application, I am satisfied that applicant has made out the case for allowing the civil application.

Hence, the following order.

i) Delay in preferring the First Appeal is condoned.

ii) Applicant to pay cost of Rs.1,500/- to the respondents original claimants or their Advocate within four weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

iii) Civil Application stands disposed of accordingly.
