DATE : MARCH 23, 2018 P.C.:- Mr.Sanjay Amarnath Sharma, a senior executive - legal of the complainant, who is authorized by an authority letter dated March 22, 2018 by the complainant-company, is present in the Court and states that he is authorized to receive the amount of compensation of Rs.1,25,000/- on behalf of the complainant and consent for compounding an offence punishable under section 138 of the Negotiable Instruments Act, 1881 ('the N.I. Act' for short).

The counsel for the applicant has handed over a demand draft dated March 21, 2018 for an amount of Rs.1,25,000/- drawn on Andhra Bank in favour of the complainant, which the complainant has acknowledged receipt of. 3.
In view thereof, the offence is compounded pursuant to the provisions of section 147 of the N.I. Act. The application stands allowed in terms of prayer clause (b). 4.
In view of the satisfaction of the liability under the N.I. Act by the applicants, as observed hereinabove the amount, if any, deposited by the applicants-accused before the trial Court is permitted to be withdrawn by moving an appropriate application before the said Court.
