Heard learned advocate for the Applicant. Advocate for the Applicant submits that he has received instructions from his clients, to withdraw the present First Appeal unconditionally. He further submits that at the time of filing the First Appeal, he had deposited Rs.25,000/- in the Registry. He submits that the said amount be transferred to the concerned Tribunal along with accrued interest if any, with liberty to the Insurance Company to withdraw the same. The same is permitted.

Learned advocate for the Applicant has given in writing for withdrawal of the present First Appeal. The same is taken on record anad marked 'X' for identification. The same is accepted. Hence following order :

(a) The Registry is directed to transfer Rs.25,000/- deposited by Insurance Company to the M.A.C.T. at Alibag in M.A.C.T. petition No.114 of 2014.

(b) The Insurance Company is permitted to withdraw the said amount from the Tribunal unconditionally. (c) First Appeal as well as pending Civil Applications stands disposed of as unconditionally withdrawn.

(d) Refund of Court fees as per law.
