It is to be informed to the learned District Judge, Pune, that explanation given by him on 01/12/2016 is not satisfactory and is rejected. His statement that the prosecution could not secure the presence of witnesses, is factually wrong, as the Investigating Officer present before the Court, has made a specific statement that he has never received any witness summons till today and therefore occasion to procure the presence of the witness did not arise.

The reasons given by the District Judge are not found good enough to accept the explanation.

The Registrar JudicialI is directed to communicate this order to concerned District Judge through learned Principle District & Sessions Judge, Pune, with specific directions that the trial be expedited on or before 24/04/2017.

If the trial is not expedited on or before 24/04/2017, the applicant/accused is at liberty to move the application for bail.
