Mr. Saraogi, the learned counsel appearing for the Appellant, on instructions seeks leave to withdraw the Appeal but requests this Court that considering the nature of relief that is sought in the suit, the City Civil Court be requested to expedite the hearing of the suit.

The limited relief sought for by the Appellant in her suit is for disclosure of the properties left by her grandfather at Philippines, Mumbai or any other places. Considering the nature of reliefs that are sought in the plaint, it would be appropriate to request the City Civil Court to expedite the hearing of the suit. The Appeal is accordingly allowed to be withdrawn with a request to the City Civil Court to expedite the hearing of the suit and to make an endeavour to decide the same as expeditiously as possible preferably within a period of one year from today.

With withdrawal of the Appeal, Interim Application does not survive. The same is disposed of as having become infurctuous. SANDEEP V. MARNE, J.
