1. For the reasons set out in the Civil Application, this Petition is restored to the file, after recalling the order of deemed dismissal.

2. However, issue fresh notice to the respondent No.1, returnable within three weeks. The petitioner to take steps to serve the respondent No.1 within the said period. Apart from usual mode of service, the petitioner is permitted to effect private service upon the respondent No.1.

3. If, within the aforesaid period, no service is effected upon the
