Heard the learned counsel (appointed) for the applicant. 2.

The learned APP submits that in the present case i.e. Sessions Case No.199 of 2012, the trial has commenced of two witnesses. In view of this, this Court is not inclined to consider an application under Section 439 of Cr.P.C. The learned counsel (appointed) prays for expeditious trial. However, the said prayer cannot be granted since the trial has already commenced and this Court is hopeful that the Sessions Judge seized with the Sessions Case No.199 of 2012 would not adjourn the proceedings on unwarranted counts. 3.

The learned counsel for the applicant has put in best efforts to
