In the suit for partition instituted by the petitioners (plaintiffs), Learned Trial Judge permitted the defendants, to recall their witness vide order dated 15.10.2016; against which this petition is preferred under Article 227 of the Constitution of India. 2.

It is against the interlocutory order this petition is preferred; which is not appealable. However the petitioners may take objection to, error or irregularity of the impugned order in the Memorandum of Appeal filed from the original decree of partition if the impugned order has affected the decision rendered in the subject suit instituted by them.
