The applicant had earlier approached this Court vide ABA No.2166 of 2021. This Court vide order dated 20th September, 2021 had recorded that after arguing for some time when Court had expressed disinclination to grant relief, learned counsel for the applicant prayed for unconditional withdrawal of the Application. Permission was granted. Application was allowed to be withdrawn unconditionally and was disposed of. 2.
Today again, the same applicant had preferred this application for same relief on the ground that the sickle allegedly used by the applicant has been recovered from co-accused
Ethape 2 15-ABA-3126-2021 Santosh. This cannot be a ground for reconsideration of the application. Since September 2021, he has not even surrendered. These repeated applications for the same relief on flimsy ground cannot be entertained. I am not inclined to entertain this application. Application is rejected. 3.
Considering that the applicant has abused the process of law by filing this application, without surrendering; cost of Rs. 10,000/- is imposed on the applicant, which shall be deposited by him with the trial Court within a period of four weeks from today, failing which the trial Court shall take appropriate steps in accordance with law.
