This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 367 of 2021 registered at Shikrapur, Police Station Pune (Rural), for the offences punishable under Sections 420, 465, 467, 468, 471, 409, 120B, 504, 506, 34 of Indian Penal Code.

I have heard the learned Counsel for the applicant and the learned APP for the State.

The bail is sought on the ground of parity. In support of the said ground the learned Counsel for the applicant has placed on record a copy of Sonali Mane 1/2

3. BA-3252-2022.doc the order dated 6th October, 2022, in Criminal Bail Application No. 4441 of 2021. By the said order this Court has released the co-accused, Sahebrao Satpute on bail.

According to the prosecution the said co-accused, Sahebrao Satpute impersonated as the complainant and executed power of attorney. The present applicant is attesting witness on the power of attorney. The applicant is in jail for more than one and half years. As this Court has released the main accused and even other co-accused, I am inclined to release the applicant on bail. Hence, the following order is passed :

ORDER

(i) Application is allowed.

(ii) The applicant be released on bail in Crime No. 367 of 2021 registered at Shikrapur, Police Station Pune (Rural), for the offences punishable under Sections 420, 465, 467, 468, 471, 409, 120B, 504, 506, 34 of Indian Penal Code. on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.
