The order impugned is interlocutory in nature, capable being challenged under Section 105 (1) of the Code of Civil Procedure, 1908. Therefore, it is open for the petitioner to challenge on appeal from such final decree to question an interlocutory order. 2.

The writ petition is, therefore, disposed of with liberty to the petitioner to challenge the impugned order in case decree is against the petitioner.
