After the matter was heard for some time, learned counsel for the appellant fairly submits that an ad-interim relief in draft Notice of Motion is granted by the impugned order dated 19/9/2016 in S.C. Suit No.2209/2016. Admittedly, the Notice of Motion itself is pending, the appellant/defendant has also not filed any reply to the Notice of Motion.

In the circumstances, it is desirable that the Notice of Motion itself is heard after reply is filed by the appellant.

All contentions of the parties on merits are expressly kept open. It will be open to the appellant/defendant to request the Trial Court for early hearing of the Notice of Motion, which shall considered by the Trial Court on its own merit. (G.S.KULKARNI, J.)
