Perused the order dated 01.10.2016 passed by the District Judge-5 and Additional Sessions Judge, Thane, on the Bail Application No.2306 of 2016 in which the condition No.3 speaks of deposit of Rs.5 lakh within the period of one month from release. The learned counsel for the applicant submits that applicant is poor person and can not deposit the said amount.

The observations in paragraph 6 of the said order speaks that the applicant volunteers to deposit the said amount of Rs.5 lakh which was found to be the basis of passing of an order of deposit. Once the applicant himself has volunteered to deposit the amount, in my opinion, relaxation as is prayed does not call for inference. The application is rejected.
