The Petitioner challenges the order passed by the Labour Court Judge, dated 29 September 2015 appointing Commissioner for computing the monetary benefits. The learned counsel for the Petitioner submitted that the learned Labour Court has concluded the issue on merits and only for computation the issue is referred to the Commissioner. He submitted that the Labour Court has no jurisdiction to go into the disputed questions. 3.

However, considering the nature of proceedings from which the impugned order arises, and that the matter has not yet been finally concluded, it will not be appropriate to interfere at this stage. The Petitioner can always challenge the final order passed in

Pro 2- WP 11557-15.doc the proceedings on such grounds that may be available in facts and law. Keeping all issues on merits open, the Writ petition is disposed of.
