The petition is directed against order dated 11th October 2022, cancelling bail granted to the applicant. The complaint was lodged against the applicant under sections 376, 354C and other sections of the Indian Penal Code, 1860 including 66B and 67 of the Information and Technology Act, 2000. The applicant was arrested on 27th February 2021. The learned Sessions Court released the applicant on bail by order dated 24th January 2022, subject to conditions amongst other that the applicant shall not tamper with the evidence or pressurize the witnesses in any manner and he shall maintain law and order.

The informant/victim filed an application for cancellation of bail under sections 374, 392 of the Code of Criminal Procedure,

20-APL-1104-2022.doc 1973, contending that the applicant sent life threatening messages to the applicant by uploading a status on his social media application in his mobile.

On perusal of the status on pages 8 and 9 of the compilation furnished by the applicant, I am satisfied that uploading of such status amounts to breach of condition of bail. The learned Additional Sessions Judge was, therefore, justified in cancelling the bail. There is no error of jurisdiction nor miscarriage of justice. 4.

The criminal application is, therefore, dismissed. No costs. (AMIT BORKAR, J.)
