This is an application for condonation of delay in preferring the Criminal Revision Application No. 625 of 2016. In the revision application, the Applicant had challenged the order passed by the Family Court seeking maintenance under Section 125 of the Code of Criminal Procedure. The Applicant, thereafter, preferred the family court appeal. The said appeal was disposed of on the ground that the same is not maintainable in accordance with Section 19 (2) of the Family Court Act and the remedy of the Applicant is to invoke Section 19 (4) of the said Act. The Applicant was granted time to adopt appropriate proceedings. Hence, the Applicant has preferred the aforesaid Revision Application. 2.
In the circumstances, there was a delay in approaching this Court in 1/2
Tikam APPR 616 of 2016.dot preferring the said revision application. Considering the aforesaid circumstances and the reasons stated in the application, the delay is required to be condoned. Hence, I pass the following order:
ORDER
(i) Criminal Application No. 616 of 2016 is allowed in terms of prayer clause (a).
(ii) The Criminal Application stands disposed of.
