Perused the order dated 4 th January, 2018. Pursuant thereto, Hon'ble Mr. Justice D.G. Karnik (Retired) has submitted his disclosure under Section 11(8) read with Section 12(1) of the Arbitration and Conciliation Act, 1996 as amended by the Arbitration and Conciliation (Amendment) Act, 2015 (Act No.3 of 2016) (the Act).

The disputes between the parties arising out of the Development Agreement dated 4 th July, 2014 (Exhibit "B" to the Petition) are referred to the sole Arbitrator Hon'ble Mr. Justice D.G. Karnik (Retired).

Parties shall appear before the Learned Arbitrator in his Chamber on 6 th February, 2018 at 11.00 a.m. and obtain necessary directions. 4.

The venue of arbitration shall be at Pune.

The cost of arbitration shall initially be borne by the parties equally. 6.

All contentions of the parties are kept open. The above Arbitration Petitions are accordingly disposed off. ( S.J.KATHAWALLA, J. )
