Crime No. 261 of 2016 registered with Charkop Police Station, Kandivali the applicant is seeking pre-arrest bail under Section 302 Indian Penal Code.

The applicant is the father-in-law. Heard learned Counsel, Ms. Upadhyay for the applicant, who would strenuously urge that the applicant is falsely named as accused in the crime in question. According to her, looking to the role attributed to the
Rane * 2/2 * ABA-1914-2016 Monday,5.12.2016 sr.no.15 applicant in the crime and the fact that the applicant was permanent resident of the village and not the place of incident, he is not connected to the crime in question. According to her, custodial interrogation is not required.

Learned APP submits that the investigation is at advanced stage and till date investigation does not reflect any incriminating material against the applicant. 4).
Perusal of the FIR depicts that Prerna alongwith her daughter committed suicide out of indifferences with her husband. The applicant is her father-in-law who is admittedly residing at mofussil place away from the son and deceased, Prerna. 5).
There is hardly any material to connect the applicant to the crime in question. In view thereof, the application stands allowed.

In the event of arrest of the applicant in C.R. No. 261 of 2016 registered with Charkop Police Station, he be released on bail on furnishing P.R. Bond of Rs.10,000/- (Rs. Ten Thousand only) with one or two sureties in the like amount.

The applicant shall attend the police station on 20th and 21st December, 2016 between 10 to 12 p.m. and thereafter as and when called by the police.

The applicant shall not tamper with the evidence and/or influence the witnesses in any manner whatsoever. (N.W. SAMBRE, J)
