It is an application under Section 24 of the Code of Civil Procedure, 1908, whereby applicant-wife is seeking transfer of divorce petition bearing H.M.P. No. 87 of 2018 pending before the learned Family Court, Kolhapur to the Court of Civil Judge, Senior Division, Islampur.

Learned Counsel for the respondent tendered an affidavit dated 26th February, 2019 sworned by the respondent. It is taken on record and marked "X" for identification. Respondent is present in the Court. He has no objection to transfer H.M.P. No.87 of 2018 filed by him from the Family Court, Kolhapur to the Court of Civil Judge, Senior Division, Islampur..

In view of the statement made in the affidavit, I pass the following order:

(i) The learned Judge, Family Court at Kolhapur is directed to transfer the papers and proceedings in H.M.P. No. 87 of 2018 to the Court of learned Civil Judge, Senior Division at Islampur.

(ii) The parties as well as the learned Judge, Family Court at Kolhapur to act on an authenticated copy of this order.

(iii) Both the parties are directed to appear before the learned Civil Judge, Senior Division at Islampur on 19th March, 2019.

(iv) The Miscellaneous Civil Application is allowed in terms of prayer clause (a) and disposed of.
