By this petition, the petitioner seeks a direction to the respondent Nos. 1 and 2 i.e -The Regional Passport Commissioner Digitally signed by RAJESHWARI SUBODH KARVE Date:

2022.07.28 10:54:53 +0530 RAJESHWARI SUBODH KARVE and Superintendent, Passport Office, Pune, to renew the petitioner's passport for a period of 10 years or as this Court deems fit and proper.

Perused the papers. At the outset, learned counsel seeks leave to amend prayer clauses (b) and (c). Leave granted.

Perused the papers. It appears that the petitioner was arraigned as an accused in connection with C.R. No.219/2018 registered with the Shahuwadi Police Station, District Kolhapur, for the alleged offences punishable under sections 143, 147, 504, 506 of the IPC. It appears that the petitioner is working at Muscat and as his passport was due for renewal, the petitioner filed an application before the Judicial Magistrate, First Class, Malkapur, Shahuwadi, Kolhapur, for renewal of his passport. The said application was filed on 2/8/2021. The learned Judicial Magistrate First Class vide order dated 20/8/2021 allowed the said application (Exhibit 16) filed in Sessions Case No.226/2019. Accordingly, the Passport Office was directed to renew petitioner's passport. It appears that the petitioner's passport was renewed for one year. 5.

Having heard learned counsel for the parties and having regard to the nature of allegations and Petitioner's nature of job, we deem it appropriate to direct the Passport Authority to renew the petitioner's passport for a period of 5 years in accordance with the Passport Act and the Rules thereunder.

The petition is allowed and disposed of on the aforesaid terms.
