By this petition, Petitioners are challenging judgment and order dated August 20, 2018 passed by the District Judge-6, Thane dismissing Misc. Civil Appeal No. 214/2015. In the Appeal, Petitioners had challenged order dated October 1, 2015 passed by the Trial Court allowing application for temporary injunction. Thus there are concurrent orders passed by the Trial Court and the first Appellate Court injuncting the Defendants from causing obstruction/interference to the possession of the Plaintiffs over the suit property. This injunction is operational since October 1, 2015. There is no interim order passed in the

Neeta Sawant 2/2 22-WP-1997-2020.doc August 17, 2023 petition. In that view, no purpose would be served in deciding whether the injunction can be lifted, at such distant point of time. 2.

Mr. Suryawanshi, learned counsel appearing for Petitioners would urge this Court to expedite disposal of Regular Civil Suit No. 21/2015. I am not aware about pendency of Suits before the Trial Court and therefore no such direction can be issued. However considering the fact that the Suit is pending since the year 2015, I am sure the Trial Court will give due priority for its final disposal considering the pendency of other matters. 3.

With the above observations, the Writ Petition is disposed of.
