1] This is an application to bring legal heirs of Respondent No.7 on record, who has died on 10/05/2005. There is delay of 9 years and 101 days, which is sought to be condoned and prayer is also made for setting aside the abatement. Learned counsel for the Respondent submits that he has no objection to allow the Civil Application. 2] In view thereof, the Civil Application is allowed and Mr.Hemraj Digamber Vadke is directed to be impleaded as Respondent No.7A.

3] The Appellant to carryout the necessary amendment in the Appeal Memo within two weeks from the date of this order. 4] After the above said amendment, place the Second Appeal on board on 26th June, 2018.
