Mr. Dande, learned counsel for the respondents-NMMC, on instructions from Mr. Girish R. Gumaste, Executive Engineer, NMMC, who is present in court today, submits that presently there is no order of black-listing that has been passed by the respondents, so as to dis-entitle the petitioner from participating in the tender process. He further submits that if petitioner submits the Bid, the same would be considered in accordance with the Tender Notice. In view of this statement, the purpose of filing the writ petition is served. 2.

payment of dues for the work that has been completed by it, it is seen that the petitioner, has on 12 th October 2022, made a representation to the Deputy Engineer of the NMMC seeking release of the amounts due. The respondents shall consider the said request in accordance with law within a period of four weeks from today and communicate the decision to the petitioner. All contentions on merits are kept open.
