Heard learned counsel for the parties.

By this First Appeal, the appellant-original claimants are challenging the judgment and award dated 01.08.2014 passed by the Railway Claims Tribunal Mumbai Bench, Mumbai in Claim Application O.A. (Iiu)/MCC/2011/0282 dismissing the appellants claim petition for a sum of Rs.4 lakhs.

Considering the submissions made by the learned counsel for the appellant and the impugned judgment and award N.S. Kamble page 1 of 2

33-fa-969-2015 dated 01.08.2014, I am satisfied that the appellant has made out case for the following order.

ORDER

(i) Admit.

(ii) Printing dispensed with.

(iii) Appellant to file private paper book within one year from today with copy to other side, failing which the appeal shall stand dismissed without referring back to the court.

(iv) Registry is directed to call for Record and Proceedings.

(v) Advocate Mr.Pranav Dhakane waives service for respondent.

(vi) Hearing of the Appeal is expedited.
