IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO. 229 OF 2015 IN REVIEW APPLICATION (STAMP) NO. 30322 OF 2014 IN WRIT PETITION NO. 9537 OF 2014 Sanjay Liladhar Umraniya ..

Applicant versus Mrs. Vahida Gaffar Shaikh & Ors.

..

Petitioners Mr. Suresh S. Shah for Applicant.

None for Respondents.

CORAM : M. S. SONAK, J.

DATE: 10 OCTOBER 2016 P.C :

1] By this civil application, condonation of delay of about ten months is applied for seeking review of the order dated 22 August 2013.

2] If the civil application is perused, it cannot be said that any sufficient cause is shown for seeking condonation of delay. Besides, the order dated 22 August 2013 records that the same was made with the consent of the learned counsel for the parties. The ground for review as well as seeking condonation of delay is that such consent was never in fact, obtained from the review petitioner. 1/2

skc 3-CAO-229-15 3] In my judgment, this is neither a ground for seeking condonation of delay nor, in the facts and circumstances of the present case, any ground for seeking recall of a consent order. 4] The application for condonation of delay is dismissed. As a consequence, the review application is also dismissed. (M. S. SONAK, J.) Chandka 2/2
