This is an application for seeking modification of order dated 2nd July, 2018. While granting bail, the applicant had tendered an undertaking to this Court. In the said undertaking, it was stated that the applicant shall deposit an amount of Rs.6,00,000/-, in the Registry of this Court before his actual release from jail and the balance amount of Rs.12,00,000/-, in

rpa 2/2 502-appp-1210-18.doc four equal installments not later than and within a period of six months from the date of his actual release from jail. Learned counsel for the applicant submits that he has complied the undertaking of deposit of Rs.6,00,000/-, in the Registry of this Court before his release. In accordance with the undertaking, the applicant is required to deposit balance amount of Rs.12,00,000/-, within six months from the date of his actual release. It is submitted that the applicant would deposit an amount of Rs.1,00,000/- immediately and the balance amount of Rs.11,00,000/- would be deposited in accordance with the order dated 2nd July, 2018.

On perusal of the undertaking and the order passed by this Court, the outer limit provided to the applicant to deposit the amount is for a period of six months from the date of his release and the amount has to be deposited in four equal installments within the said period. In this circumstances, the question of modification of the said order by allowing the applicant to deposit Rs.1,00,000/-, now does not arise. Applicant has to comply the order dated 2nd July, 2018, and deposit the balance amount within a period specified in the said order. Criminal Application No.1210 of 2018, stands disposed of.
