IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO.13493 OF 2017 Vijay Pundalik Kesarkar
...Petitioner
vs.
High Court of Judicature at Bombay & Ors.
...Respondents
Ms Vaishali Y. Agane for the Petitioner Mr.A.S.Bhat I/b Mr.Rahul Nerlekar for the respondent Nos.1 and 2.
CORAM : A.S.OKA, & SANDEEP K. SHINDE, JJ.
DATE : NOVEMBER 29, 2018 P.C.:
One of the grievances made in this petition is that Administrative Appeal preferred by the petitioner against the impugned order dated 27th January 2015 of removal of service is still pending. The learned counsel for the respondents on instructions states that the appeal is pending. It will be appropriate if the appeal is disposed of expeditiously. We therefore request the first respondent on the administrative side to take up the appeal for hearing and dispose it of as expeditiously as possible.
wp13493.doc With the above observations, writ petition is disposed of.
We, however, make it clear that if the petitioner does not succeed in the appeal, it will be open for him to file a fresh petition for challenging the order of removal from service. All contentions on merits are kept open.
