Heard Mr. Patwardhan for the Applicant and Mr. Gangal for the Respondent Nos. 2, 3 and 4.

All that has happened in this matter is that the legal heirs of one of the parties have been permitted to be brought on record. No doubt, the order to this effect was made in favour of Plaintiff No.6 who was to comply with the order and pay costs of Rs.3000/-. Since he did not comply with the order, the other Plaintiffs i.e. Plaintiff Nos. 1 to 4 offered to pay the costs and comply with the order. This was permitted by the learned Trial Judge. Now, the Applicant, who is Defendant No.4 in the Habeeb 1/2
909.cra.1133.14.doc suit, again really complains that such procedure was irregular. Even assuming that there is some minor irregularity in the procedure, this is certainly not a ground made out to interfere in exercise of Revisional Jurisdiction.

For the aforesaid reason, Revision Application is dismissed. There shall be no order as to costs.
