Heard learned Counsel for the applicant. Though, the respondents are duly served, no one appeared on behalf of them when the matter called out.

This Application is preferred by the insurance company for condonation of 90 days delay in preferring First Appeal challenging the award dated 01.04.2014 passed by the M.A.C.T. Thane in M.A.C.P. No. 253 of 2009.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the Sneha Chavan 1/2

Hence, the following order:

i) Civil Application is allowed in terms of prayer clause (a) which read thus:

"a) The delay of 90 days in filing the appeal may kindly be condoned"

ii) Rule made absolute accordingly.

iii) Civil application stands disposed off accordingly.
