Having regard to the judgment of the Apex Court reported in 1966(3) SC Reports 300 in the matter of Sheodan Singh Vs. Daryao Kunwar, the Petitioner would have to file a Second Appeal to challenge the impugned order. The Petition is accordingly allowed to be withdrawn with liberty to file a Second Appeal. If the issue of limitation arises, the fact that the Petitioner was prosecuting the instant Petition can be urged by him.
