The proposal of the petitioners seeking approval to the appointment of petitioner no.1 as a Junior Clerk is rejected on the ground that there was ban on the recruitment imposed by the State Government. The learned counsel for the petitioners submits that the petitioner no.1 is appointed in a minority educational institution/petitioner no.2.

The reliance is placed on the judgment of the Division Bench of this Court dated 27 June, 2019 in Writ Petition No.7962 of 2017 and the order dated 20 June, 2022 passed in Writ Petition No.1615 of 2022.

Considering the aforesaid judgment and the order, the impugned order is quashed and set aside.

The Education Officer shall reconsider the proposal of the petitioners seeking approval to the appointment of petitioner no.1 afresh and shall consider regarding the availability of post and all other requisites. The proposal shall be decided preferably within 6 months.
