Mr. Bandiwadekar, having taken instructions from his client, seeks leave to withdraw this petition with liberty to file fresh application with respondent No.2, for sanction of 2nd Division of Standard X (Kannada medium) and 3rd Division of Standard X (Marathi medium). Leave with liberty granted.

In the event if the petitioner files such application within a period of two weeks from today, respondent shall process the same in accordance with law, as expeditiously as possible and preferably within a period of six weeks from the date of receipt of this order, and if necessary

It is expressly made clear that we have not gone into the merits of petitioner's entitlement about 2nd division in Kanada Medium and 3rd Division of Marathi Medium and respondent No.2 shall take its decision in this regard independently and in accordance with law.
